POWER OF ATTORNEY 101:  BASICS ABOUT ILLINOIS POWER OF ATTORNEYS

WHAT IS  POWER OF ATTORNEY?

A Power of Attorney in Illinois is generally a power that a principal (the person that creates the power of attorney) gives an agent that empowers them to make financial decisions and healthcare related decisions.  There are two (2) forms of Illinois Powers of Attorneys: a) Illinois Short Form Durable Power of Attorney for Property and b) Illinois Short Form Power of Attorney for Healthcare.

Under 755 ILCS 45/Illinois Power of Attorney Act is what regulates Agents and the Illinois Power of Attorney for Property and Healthcare decisions.

WHAT IS AN ILLINOIS SHORT FORM DURABLE POWER OF ATTORNEY FOR PROPERTY?

An Illinois Power of Attorney for Property is a legal document which empowers a person to make financial decisions such as writing checks, paying bills, cashing social security checks, paying mortgages and credit card bills among other financial decisions.  With an Illinois Power of Attorney for Property, you can make the power of attorney contingent upon certain things such as an physician’s note that the principal is unable to understand their financial decisions and the consequences of those financial decisions.  Or, perhaps, a principal or a person creating a power of attorney for property wants to enable the agent to start making financial decisions for themselves immediately.

WHAT IS AN ILLINOIS SHORT FORM DURABLE POWER OF ATTORNEY FOR HEALTHCARE?

An Illinois Power of Attorney for Healthcare deals with healthcare related issues such as nursing home or hospital related issues.  The purpose of the power of attorney for healthcare is to appoint a person to make important healthcare decisions for themselves when they are incapable to making their own healthcare related decisions.  Unlike a power of attorney for property, a healthcare power of attorney addresses healthcare and medical related decisions. Both the Illinois Power of Attorney for Property and Healthcare are necessary.

WHO NEED A POWER OF ATTORNEY FOR PROPERTY AND HEALTHCARE?

A Power of Attorney for Healthcare and Property is needed by everybody, but practically speaking, the elderly and senior citizens and those facing surgery or other medically related decisions such as Cancer tend to make getting an Illinois Power of Attorney for Healthcare and Property a more urgent matter.
